A lease or licence agreement is a legally binding contract between a landlord and a tenant. It outlines the terms and conditions of renting a property, including the rent amount, the duration of the tenancy, and the responsibilities of both parties. This agreement is essential for protecting the rights of the landlord and the tenant and ensures a clear understanding of their obligations regarding the rental property.
Lease or licence agreements must not be agreed or signed without the involvement of the Morgan Sindall estates manager.
The site establishment team must:
- Identify suitable facilities to suit their needs. If the team, primarily the project manager, hasn’t been able to identify suitable facilities, the Morgan Sindall estates manager will be able to advise of suitable retained agents who can undertake market searches.
- Once a suitable location has been identified, the project manager must complete a ‘Request for Premises form’ available from the Morgan Sindall estates manager, along with a suitable business case.
- Ensure the ‘Request for Premises’ form is signed off by the relevant Business Unit managing director to justify the business case.
- Obtain support from the Morgan Sindall estates manager with engaging with solicitors to draw up/review the terms and conditions on the lease or licence agreement.
- Note: If the solicitors are engaged too early abortive fees may be incurred if delays to the mobilisation date occur.
- Ensure the Morgan Sindall estates manager has a minimum of four to six weeks’ notice, if the premises are habitable, to allow all options to be considered.
- If the premises are inhabitable, engage with the Morgan Sindall estates manager who will be able to advise of suitable fit out organisations.
- Ensure landlords consent has been sought if there is a proposal to make adjustments to the services. Other modifications, e.g. partitioning or painting are often with the terms of the lease agreement.
- Engage the Morgan Sindall estates manager for any land agreements for site compounds/laydown areas.
The site establishment team should consider:
- The need for an office manager (full time preferable) to control/manage the office and housekeeping, providing a single point of contact for the landlord and Morgan Sindall estates manager.
Reminder
- Most leases are typically five years with a three year break clause. A licence can either be monthly rolling or fixed terms.
- A preferred serviced office is one price and often inclusive of all utilities and services charges.
- When operating in a joint venture where the partners may lead on the negotiations or when the customer leads on negotiations, in either instance the Morgan Sindall estates manager must still be consulted as the Morgan Sindall Infrastructure managing director and finance director will still be signatories on the lease agreement.
